This Privacy Policy applies to the CreatorWerk website, applications, and services (collectively referred to as the “Service”) that help connect content creators and professionals for photo and video shoots.

  • Contact Information: name, email address, phone number.
  • Account Information: date of birth, password, government issued ID for identification and proof of legal age.
  • Profile Information: professional background, gender, interests, preferences, approximate location, geolocation, portfolio, availability, social media data.
  • Content Information: photos, videos, audio, text and other types of content, such as your chats with other members
  • Payment Information: financial details for payment processing.
  • Interaction Information: communications with other users, preferences, and settings.
  • Third-Party Information: information that you share about others (e.g., using someone’s contact details for a feature or submitting a query or report about a member), we process that data on your behalf to fulfill your request.

We collect data from your device(s) when you use the service, including:

  • App settings and characteristics
  • App crashes
  • Advertising IDs
  • Identifiers from cookies or other technologies that uniquely identify your device or browser (see our Cookie Policy for more info)

    • We can’t verify your identity.

  • Requests Involving Other Members:
    If you’re requesting data related to another member (like messages), that member will need to submit the request themselves.
  • Appeal Process for U.S. Residents (Virginia, Colorado, Connecticut):
    If we deny your privacy request, you can appeal by contacting us and referring to “Privacy Request Appeal.” If you’re still concerned, you can contact your state’s attorney general.

7. How Long We Retain Your Data
We retain your personal data only as long as necessary for legitimate business reasons or as required by law:

  • Active Users:
    Your data is retained while your account is active.
  • Inactive Accounts:
    If your account is inactive for two years, we may close the account and delete your data within three months, except where legal or regulatory obligations require us to retain certain information.

After account closure, we handle data deletion as follows:

  • Safety Retention Window:
    We retain your data for three months post-account closure to investigate unlawful or harmful activities, based on our legitimate interest and to safeguard potential third-party victims.
  • Legal Retention Obligations:
    We keep certain data to meet legal requirements, such as:

    • Transaction data for 10 years (for tax and accounting purposes)
    • Credit card information for as long as a transaction can be challenged
    • “Traffic data” or logs for one year to comply with legal requirements
    • Records of consents given by members for five years to show compliance with the law
  • Legitimate Interests Retention:
    We retain certain data to support our operations and protect legal interests:

    • Customer care records and support data for five years
    • Imprecise location of downloads/purchases for five years (for safety purposes)
    • Profile data for one year in case of potential litigation
    • Data on banned members to prevent new account creation, as long as necessary for member safety
  • Ongoing Legal Matters:
    If there is an outstanding issue, claim, or dispute, we retain data until it’s resolved. This includes responding to valid legal subpoenas or requests to preserve data.
  • Anonymized Data:
    Where legally permitted, we may retain and use anonymized data (which can’t identify you) to improve services, develop new features, and ensure safety.

8. Collection, Use and Disclosure of Personal Information by Third Parties
This Policy covers only the collection and use of Personal Information by us. If you share your Personal Information with others while using the CreatorWerk platform or other websites, different rules may govern how that information is used, stored, or shared. CreatorWerk does not control the privacy practices of third parties, and your information will be subject to their privacy policies.

9. Your Use of Information from Other CreatorWerk Platform Members
You are prohibited from using another CreatorWerk platform member’s information, whether private or public, for commercial purposes, spamming, harassment, or making illegal threats. We reserve the right to terminate accounts of users who misuse member information or violate any user agreements, policies, or rules governing the CreatorWerk platform.

10. Do Not Share Your Personal Information or Password
Please do not post, share, or disclose any Personal Information in public forums (such as chat rooms or blogs) that you do not want other members to see. Always ask questions before sharing your Personal Information with others. Additionally, never share your password with anyone. If your password is compromised, you may lose control over your Personal Information and could be subject to actions taken on your behalf. If you believe your password has been compromised, change it immediately and/or contact us.

11. How We Protect Your Information
CreatorWerk employs reasonable security measures to help safeguard your information from loss, misuse, and alteration. We use industry-standard protections, including firewalls, to secure your Personal Information. Although “perfect security” is not achievable online or anywhere else, our technical team works diligently to ensure the secure use of our services.

12. Where We Are Located
CreatorWerk is based in the United States. If you access the CreatorWerk platform from outside the U.S., be aware that your Personal Information may be transferred to, stored, and processed in the United States or other countries where CreatorWerk or its service providers operate. The data protection laws in these locations may not be as comprehensive as those in your country, and your Personal Information could be accessible to law enforcement authorities in the U.S. or other countries.

By using the CreatorWerk platform, you consent to the transfer of your Personal Information (including Sensitive Personal Information) from your country to the United States or other countries where CreatorWerk or its service providers are located, as outlined in this Policy.

13. Children’s Privacy
Our service is only available to individuals who are 18 years or older. Users under the age of 18 are not allowed on our platform. If you become aware of a minor using our platform, please contact us immediately.
